By using our website, contacting us for a quote, or engaging our services, you agree to these terms and conditions. If you do not agree, please do not use our website or engage our services.
We reserve the right to update these terms at any time. Updated terms will be posted on this page with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the updated terms.
Visalia Epoxy Flooring & Concrete Polishing provides concrete flooring services including epoxy floor coatings, polished concrete, stained concrete, garage floor coatings, concrete resurfacing, and related surface preparation and sealing work. Services are performed in Visalia, CA and surrounding communities.
We reserve the right to decline any project at our discretion, including projects that are outside our service area, that require specialized capabilities we do not offer, or where site conditions are unsafe.
All estimates are provided in writing and reflect the scope of work discussed at the time of assessment. Estimates are valid for 30 days from the date issued unless otherwise stated in writing.
Estimates are based on site conditions at the time of assessment. If unforeseen conditions are discovered once work begins - such as hidden moisture, structural cracks, previously applied coatings, or contamination - we will notify you promptly and provide a written change order before proceeding with any additional work. No additional charges will be incurred without your written or verbal approval.
Prices on our website and in marketing materials are for general reference only and do not constitute a binding quote. Actual pricing is determined by on-site assessment.
Project dates are confirmed in writing or by phone after both parties agree to the scope and pricing. We request at least 48 hours notice if you need to reschedule or cancel a confirmed appointment.
We reserve the right to reschedule work due to weather conditions, material availability, or circumstances outside our control. We will notify you as soon as possible and work with you to find the next available date.
For certain projects, a deposit may be required to hold your scheduled date. Deposit terms will be stated in your written estimate. Deposits are non-refundable if you cancel with fewer than 48 hours notice after a project date has been confirmed.
Payment is due upon project completion unless other terms are stated in writing in your estimate. For larger projects, we may require a deposit before work begins, with the balance due upon completion.
Accepted payment methods will be communicated at the time of estimate. Invoices not paid within 30 days of the due date may be subject to a late fee of 1.5% per month on the outstanding balance. We reserve the right to pursue collection of unpaid balances through available legal means.
Customer is responsible for ensuring that the work area is accessible and prepared as agreed. If we arrive and the work area is not prepared, we may need to reschedule, and a re-mobilization fee may apply.
We stand behind the quality of our work. If you believe a defect in workmanship exists, please contact us within 30 days of project completion and we will inspect and address the issue at no charge, provided the defect is due to our workmanship and not misuse, neglect, or conditions outside our control.
Our warranty covers workmanship only and does not cover damage caused by improper use, heavy impact, chemical spills not disclosed prior to project start, acts of nature, or substrate movement (including soil shifting, structural settlement, or moisture intrusion from below the slab).
Product warranties, where applicable, are governed by the product manufacturer and not by Visalia Epoxy Flooring & Concrete Polishing. We will assist you in understanding and pursuing manufacturer warranty claims if a product defect is suspected.
Visalia Epoxy Flooring & Concrete Polishing is not liable for any indirect, incidental, special, or consequential damages arising from the use of our services or website, including but not limited to lost profits, loss of use, or damage to property not directly caused by our workmanship.
Our total liability for any claim related to services we performed is limited to the amount paid for the specific project giving rise to the claim. Nothing in these terms limits our liability for bodily injury caused by our negligence.
You are responsible for ensuring the work area is cleared of all furniture, vehicles, equipment, and stored items before the scheduled start date. You are also responsible for disclosing any known conditions that may affect our work, including previous coatings, sealers, moisture problems, or structural issues.
Failure to disclose known conditions may affect the performance of the finished work and may void our workmanship warranty. We are not liable for failures caused by undisclosed pre-existing conditions.
If a dispute arises regarding our services or these terms, we ask that you contact us first to attempt an informal resolution. Most issues can be resolved through direct communication, and we are committed to working in good faith to address any legitimate concern.
If informal resolution is not possible, disputes will be resolved through binding arbitration in Visalia, CA, under the rules of the American Arbitration Association. Each party is responsible for their own legal fees unless the arbitrator awards otherwise. Class action claims are waived by both parties.
These terms and any dispute arising out of our services or website are governed by the laws of the State of California, without regard to its conflict of law provisions. Any legal proceedings not subject to arbitration will be brought in the courts of Tulare County, California.
